# §208.104. Applicability.

- (a) This part applies to HUD administered subsidized multifamily projects, either insured or non-insured, under:
  - (1) The [section 236](/cfr/24/236.md) Interest Reduction and Rental Assistance Payments program;
  - (2) The [section 8](/cfr/24/8.md) Housing Assistance Payments Programs, including, but not limited to, [section 8](/cfr/24/8.md) Housing Assistance Payments Programs for New Construction ([24 CFR part 880](/cfr/24/part880.md)), [section 8](/cfr/24/8.md) Housing Assistance Payments Program for Substantial Rehabilitation ([24 CFR part 881](/cfr/24/part881.md)), [section 8](/cfr/24/8.md) Housing Assistance Payments Program, New Construction Set-Aside for [section 515](/cfr/24/515.md) Rural Rental Housing Projects ([24 CFR part 884](/cfr/24/part884.md)); Loans for Housing for the Elderly or Handicapped ([24 CFR part 885](/cfr/24/part885.md)) and [section 8](/cfr/24/8.md) Loan Management and Property Disposition Set-aside program ([24 CFR part 886](/cfr/24/part886.md));
  - (3) The [section 221(d)(3)](/cfr/24/221.md?p=d-3) Below Market Interest Rate Housing for Low and Moderate Income Mortgage Insurance program ([24 CFR part 221](/cfr/24/part221.md)); and
  - (4) **The section 101 Rent Supplement program (24 CFR part 215).**
- (b) This part applies to those multifamily projects having subsidy contracts, either insured or non-insured, where State housing finance and development agencies and other Public Housing Agencies are the subsidy contract administrator under:
  - (1) The [section 236](/cfr/24/236.md) Interest Reduction and Rental Assistance Payments program ([24 CFR part 236](/cfr/24/part236.md));
  - (2) The [section 8](/cfr/24/8.md) Housing Assistance Payments Programs, including, but not limited to, [section 8](/cfr/24/8.md) Housing Assistance Payments Program for New Construction ([24 CFR part 880](/cfr/24/part880.md)), [section 8](/cfr/24/8.md) Housing Assistance Payments Program for Substantial Rehabilitation ([24 CFR part 881](/cfr/24/part881.md)), and [section 8](/cfr/24/8.md) Housing Assistance Payments Program, New Construction Set-Aside for [section 515](/cfr/24/515.md) Rural Rental Housing Projects ([24 CFR part 884](/cfr/24/part884.md));
  - (3) The [section 221(d)(3)](/cfr/24/221.md?p=d-3) Below Market Interest Rate Housing for Low and Moderate Income Mortgage Insurance Program ([24 CFR part 221](/cfr/24/part221.md)); and
  - (4) **The section 101 Rent Supplement program (24 CFR part 215).**
- (c) This part applies to all other subsidized [section 202](/cfr/24/202.md) projects, which include: [section 202](/cfr/24/202.md) projects with rent supplement or loan management set aside, [section 202](/cfr/24/202.md) projects with [section 162](/cfr/24/162.md) assistance, and [section 202](/cfr/24/202.md) Supportive Housing for the Elderly. This part also applies to [section 811](/cfr/24/811.md) Supportive Housing for Persons With Disabilities.
- (d) This part does not apply to the [section 8](/cfr/24/8.md) Existing Housing Program or the Moderate Rehabilitation program.
