# §1005.449. Qualified mortgage.


A [Section 184](/cfr/24/184.md) Guaranteed Loan, except for mortgage transactions exempted under [15 U.S.C. 1639c(b)(3)(ii)](/usc/15/1639c.md?p=b-3-ii), is afforded safe harbor as a qualified mortgage that meets the ability-to-repay requirements in [15 U.S.C. 1639c(a)](/usc/15/1639c.md?p=a).
