# §1005.405. Borrower residency status.

- (a) An eligible Borrower who is an Indian must be:
  - (1) A U.S. citizen; or
  - (2) **A lawful permanent resident alien.**
- (b) Documentation must be provided to the Direct Guarantee Lender to support lawful residency status as defined in the Immigration and Nationality Act, codified at [8 U.S.C. 1101](/usc/8/1101.md), et seq.
