# §1000.42. Are the requirements of Section 3 of the Housing and Urban Development Act of 1968 applicable?


No. Recipients shall comply with Indian preference requirements of [Section 7(b)](/cfr/24/7.md?p=b) of the Indian Self-Determination and Education Assistance Act ([25 U.S.C. 5307(b)](/usc/25/5307.md?p=b)), or employment and contract preference laws adopted by the recipient's tribe in accordance with [Section 101(k)](/cfr/24/101.md?p=k) of NAHASDA.
