# §1000.40. Do lead-based paint poisoning prevention requirements apply to affordable housing activities under NAHASDA?


Yes, lead-based paint requirements apply to housing activities assisted under NAHASDA. The applicable requirements for NAHASDA are HUD's regulations at [part 35](/cfr/24/part35.md), subparts [A](/cfr/24/subpartA.md), [B](/cfr/24/subpartB.md), H, J, K, M and R of this title, which implement the Lead-Based Paint Poisoning Prevention Act ([42 U.S.C. 4822-4846](/usc/42/4822-4846.md)) and the Residential Lead-Based Paint Hazard Reduction Act of 1992 ([42 U.S.C. 4851-4856](/usc/42/4851-4856.md)).
