# §635.603. Applicability.

- (a) Except as provided in [paragraph (b)](#b) of this section, the provisions of this subpart apply to all Federal-aid construction projects.
- (b) This subpart does not apply to engineering and design service contracts, to which [23 CFR part 172](/cfr/23/part172.md) applies, or Federal Lands Highway contracts, to which [48 CFR subpart 16.5](/cfr/48/subpart16.5.md) applies.
