# §490.315. Establishment of minimum level for condition of pavements.

- (a) For the purposes of carrying out the requirements of [23 U.S.C. 119(f)(1)](/usc/23/119.md?p=f-1), the percentage of lane-miles of Interstate System in Poor condition, as computed per [§ 490.313(e)(3)](/cfr/23/490.313.md?p=e-3), shall not exceed 5.0 percent except as noted in [paragraph (b)](#b) of this section.
- (b) For the purposes of carrying out the requirements of [23 U.S.C. 119(f)(1)](/usc/23/119.md?p=f-1), the percentage of lane-miles of Interstate System in Poor condition within the State of Alaska, as computed per [§ 490.313(e)(3)](/cfr/23/490.313.md?p=e-3), shall not exceed 10.0 percent.
