# §450.338. Applicability of NEPA to metropolitan transportation plans and programs.


Any decision by the Secretary concerning a metropolitan transportation plan or TIP developed through the processes provided for in 23 U.S.C. [134](/usc/23/134.md), [49](/usc/23/49.md) U.S.C. 5303, and this subpart shall not be considered to be a Federal action subject to review under the National Environmental Policy Act of 1969 ([42 U.S.C. 4321](/usc/42/4321.md) et seq.).
