# §35.10. Background.


This subpart implements the Administrative False Claims Act, codified at [31 U.S.C. 3801 through 3812](/usc/31/3801..3812.md). [Section 3809](/cfr/22/3809.md) of that Act requires each authority head to promulgate regulations necessary to implement the provisions of the statute. Administrative False Claims Act liability is identified at [31 U.S.C. 3802](/usc/31/3802.md). Liability for claims can include an assessment of up to twice the amount of the false claim and a civil penalty. Liability for a false statement is a civil penalty. The civil penalty for a false claim or false statement actionable under that section is $14,308.
