# §684.430. What individuals are eligible to receive supplemental youth services?

- (a) Participants in supplemental youth services activities must be:
  - (1) American Indian, Alaska Native or Native Hawaiian as determined by the INA program grantee according to [§ 684.300(a)](/cfr/20/684.300.md?p=a);
  - (2) Between the age of 14 and 24; and
  - (3) **A low-income individual as defined at WIOA sec.** 3(36) except up to five percent of the participants during a program year in an INA youth program may not be low-income individuals provided they meet the eligibility requirements of paragraphs [(a)(1)](#a-1) and [(2)](#a-2) of this section.
- (b) For the purpose of this section, the term “low-income,” used with respect to an individual, also includes a youth living in a high-poverty area.
