# §30.511. What is an “overpayment” for purposes of EEOICPA?


An “overpayment” is any amount of compensation paid under sections [7384s](/cfr/20/7384s.md), [7384t](/cfr/20/7384t.md), [7384u](/cfr/20/7384u.md), [7385s-2](/cfr/20/7385s-2.md) or [7385s-3](/cfr/20/7385s-3.md) of the EEOICPA to a recipient that constitutes, as of the time OWCP makes such payment:

- (a) Payment where no amount is payable under this part; or
- (b) **Payment in excess of the correct amount determined by OWCP.**
