# §1001.123. Performance standards governing the assignment and role of Local Veterans' Employment Representatives (LVERs).

- (a) To carry out the requirements of [38 U.S.C. 2004](/usc/38/2004.md), at least one member of each State agency staff, preferably an eligible veteran, shall be designated and assigned by each State agency administrator as a full-time or part-time LVER in each SDP in accordance with terms/requirements of a grant agreement approved by the ASVET. The ASVET intends to use the following criteria in establishing the terms and requirements of grant agreements:
  - (1) At least one full-time LVER shall be assigned in each SDP which has had 1,000 new or renewed applications from veterans and eligible persons during the most recent twelve-month report period unless a waiver based on demonstrated lack of need is granted by the ASVET, and
  - (2) At least one part-time LVER whose time shall be devoted to veterans' services in proportion to the full-time criteria shall be assigned to each SDP not meeting the criteria for full-time LVERs in [paragraph (a)(1)](#a-1) of this section.
- (b) Additional full-time or part-time LVERs may be assigned based on a determination of need by the State agency administrator and in accordance with terms/requirements of a grant agreement approved by the ASVET.
- (c) Each LVER shall perform, at the SDP level, the duties prescribed at [38 U.S.C. 2003(c)](/usc/38/2003.md?p=c) required by [38 U.S.C. 2004](/usc/38/2004.md).
