# §10.736. What are the time limits for filing a LEO claim?


OWCP must receive a claim for benefits under [5 U.S.C. 8191](/usc/5/8191.md) within five years after the injury or death. This five-year limitation is not subject to waiver. The tolling provisions of [5 U.S.C. 8122(d)](/usc/5/8122.md?p=d) do not apply to these claims.
