# §200.212. Public access to Federal award information.

- (a) Except as noted in [paragraph (c)](#c) of this section, the Federal agency must publish the required Federal award information on USAspending.gov in accordance with the guidance provided by OMB and the U.S. Department of the Treasury's Government-wide Spending Data Model (GSDM).
- (b) All responsibility and qualification records posted in SAM.gov will be publicly available after a waiting period of 14 calendar days, except for:
  - (1) Past performance reviews required by Federal Government contractors (See Federal Acquisition Regulation (FAR) [48 CFR part 42](/cfr/48/part42.md), [subpart 42.15](/cfr/2/subpart42.15.md));
  - (2) Information that was entered prior to April 15, 2011; or
  - (3) **Information that is withdrawn during the 14-calendar day waiting period by a Federal agency.**
- (c) Nothing in this section may be construed as requiring the publication of information otherwise exempt under the Freedom of Information Act ([5 U.S.C. 552](/usc/5/552.md)), or controlled unclassified information pursuant to Executive Order 13556.
