# §184.8. Exemptions to the Buy America Preference.

- (a) The Buy America Preference does not apply to expenditures for assistance authorized under section [402](/cfr/2/402.md), [403](/cfr/2/403.md), [404](/cfr/2/404.md), [406](/cfr/2/406.md), [408](/cfr/2/408.md), or [502](/cfr/2/502.md) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. [5170a](/usc/42/5170a.md), [5170b](/usc/42/5170b.md), [16](/usc/42/16.md) 5170c, 5172, 5174, or 5192) relating to a major disaster or emergency declared by the President under section [401](/cfr/2/401.md) or [501](/cfr/2/501.md), respectively, of such Act (42 U.S.C. [5170](/usc/42/5170.md), [5191](/usc/42/5191.md)) or pre and post disaster or emergency response expenditures.
- (b) “Pre and post disaster or emergency response expenditures” consist of expenditures for financial assistance that are:
  - (1) Authorized by statutes other than the Stafford Act, [42 U.S.C. 5121](/usc/42/5121.md) et seq.; and
  - (2) Made in anticipation of or response to an event or events that qualify as an “emergency” or “major disaster” within the meaning of the Stafford Act, 42 U.S.C. [5122(1)](/usc/42/5122.md?p=1), [(2)](/usc/42/5122.md?p=2).
