# §122.81. Application.

- (a) **Aircraft arriving with cargo.** Aircraft arriving in the U.S. from a foreign area with cargo shown on the manifest to be traveling to other airports in the U.S. or to foreign areas may proceed under the provisions of this subpart.
- (b) **Aircraft arriving with no cargo.** Aircraft arriving in the U.S. from a foreign area with no cargo on board, and requesting immediate examination and release, may proceed if a bond on Customs Form 301, containing the bond conditions set forth in [subpart G of part 113](/cfr/19/part113-subpartG.md) of this chapter, has been filed and covers the aircraft.
