# §122.161. In general.


Except as provided in [subpart S](/cfr/19/subpartS.md) of this part, any person who violates any Customs requirements stated in this part, or any regulation that applies to aircraft under [§ 122.2](/cfr/19/122.2.md), is, in addition to any other applicable penalty, subject to civil penalty of $5,000 as provided by 19 U.S.C. [1644](/usc/19/1644.md) and [1644a](/usc/19/1644a.md), except for overages, and failure to manifest narcotics or marihuana, in which cases the penalties set forth in [section 584](/cfr/19/584.md), Tariff Act of 1930, as amended ([19 U.S.C. 1584](/usc/19/1584.md)) apply, or for failure to report arrival or to present the documents required by [§ 122.27(c)](/cfr/19/122.27.md?p=c) of this part in which cases the penalties set forth in [section 436](/cfr/19/436.md), Tariff Act of 1930, as amended ([19 U.S.C. 1436](/usc/19/1436.md)) apply, and any aircraft used in connection with any such violation shall be subject to seizure and forfeiture, as provided for in the Customs laws. A penalty or forfeiture may be mitigated under [part 171](/cfr/19/part171.md) of this chapter.
