# §292.601. Exemption to qualifying facilities from the Federal Power Act.

- (a) **Applicability.** This section applies to qualifying facilities, other than those described in [paragraph (b)](#b) of this section. This section also applies to qualifying facilities that meet the criteria of section 3(17)(E) of the Federal Power Act ([16 U.S.C. 796(17)(E)](/usc/16/796.md?p=17-E)), notwithstanding [paragraph (b)](#b).
- (b) **Exclusion.** This section does not apply to a qualifying small power production facility with a power production capacity which exceeds 30 megawatts, if such facility uses any primary energy source other than geothermal resources.
- (c) **General rule.** Any qualifying facility described in [paragraph (a)](#a) of this section shall be exempt from all sections of the Federal Power Act, except:
  - (1) Sections [205](/cfr/18/205.md) and [206](/cfr/18/206.md); however, sales of energy or capacity made by qualifying facilities 20 MW or smaller, or made pursuant to a contract executed on or before March 17, 2006 or made pursuant to a state regulatory authority's implementation of [section 210](/cfr/18/210.md) the Public Utility Regulatory Policies Act of 1978, [16 U.S.C. 824a-1](/usc/16/824a-1.md), shall be exempt from scrutiny under sections [205](/cfr/18/205.md) and [206](/cfr/18/206.md);
  - (2) Section [1-18](/cfr/18/1-18.md), and [21-30](/cfr/18/21-30.md);
  - (3) Sections [202(c)](/cfr/18/202.md?p=c), [210](/cfr/18/210.md), [211](/cfr/18/211.md), [212](/cfr/18/212.md), [213](/cfr/18/213.md), [214](/cfr/18/214.md), [215](/cfr/18/215.md), [220](/cfr/18/220.md), [221](/cfr/18/221.md) and [222](/cfr/18/222.md);
  - (4) [Sections 305(c)](/cfr/18/305.md?p=c); and
  - (5) Any necessary enforcement provision of part III of the Federal Power Act (including but not limited to sections [306](/cfr/18/306.md), [307](/cfr/18/307.md), [308](/cfr/18/308.md), [309](/cfr/18/309.md), [314](/cfr/18/314.md), [315](/cfr/18/315.md), [316](/cfr/18/316.md) and [316A](/cfr/18/316A.md)) with regard to the sections listed in paragraphs [(c)(1)](#c-1), [(2)](#c-2), [(3)](#c-3) and [(4)](#c-4) of this section.
