# §1309.8. Who has the burden of proving that an action is excepted?


The burden of proving that an age distinction or other action falls within the exceptions outlined in §§ [1309.6](/cfr/18/1309.6.md) and [1309.7](/cfr/18/1309.7.md) is on the recipient of financial assistance from TVA.
