# §5.64. Initial decision.


[Section 3.51](/cfr/16/3.51.md) of the Commission's Rules of Practice shall govern the initial decision in proceedings under this subpart, except that the determination of the Administrative Law Judge must be supported by a preponderance of the evidence.
