# §1502.1. Scope.


The procedures in this part apply when—

- (a) A person has a right to an opportunity for a hearing under sections 2(q)(1)(B) or 3(a) of the Federal Hazardous Substances Act (“FHSA”) and 701(e) of the Federal Food, Drug, and Cosmetic Act (“FDCA”) (15 U.S.C. [1261(q)(1)(B)](/usc/15/1261.md?p=q-1-B) and [1262(a)](/usc/15/1262.md?p=a), and [21](/usc/15/21.md) U.S.C. 371(e));
- (b) The Commission elects to hold a hearing under [section 3(e)(1)](/cfr/16/3.md?p=e-1) of the FHSA or section 5 of the Poison Prevention Packaging Act (“PPPA”) and [section 701(e)](/cfr/16/701.md?p=e) of the FDCA (15 U.S.C. [1262(e)(1)](/usc/15/1262.md?p=e-1) and [1474(a)](/usc/15/1474.md?p=a), and [21](/usc/15/21.md) U.S.C. 371(e)); or
- (c) The Commission concludes that it is in the public interest to hold a formal evidentiary public hearing on any matter before it in such a proceeding.
