# §6.5. Subsequent annual adjustments for inflation to civil monetary penalties.


The Secretary of Commerce or his or her designee by regulation shall make subsequent adjustments for inflation to the Department of Commerce's civil monetary penalties annually, which shall take effect not later than January 15, notwithstanding [section 553](/usc/5/553.md) of title 5, United States Code.
