Engaging in air transportation as defined in 49 U.S.C. Subtitle VII by a foreign aircraft without a foreign air carrier permit issued pursuant to [49 U.S.C. 41301](/usc/49/41301.md) or an exemption, or in violation of the terms of such authority constitutes not only a violation of this part but of [Title 49](/cfr/49.md), subtitle VII, as well, which entails a criminal penalty as set forth in [49 U.S.C. 46316](/usc/49/46316.md).
