# §1252.202. Burden of proof.


The burden of proving that an age distinction or other action falls within the exceptions outlined in § [1252.201 (b)](/cfr/14/1252.201.md?p=b) and [(c)](/cfr/14/1252.201.md?p=c) is on the recipient of Federal financial assistance.
