# §120.5. Procedures.


Each employer having a drug and alcohol testing program under this part must ensure that all drug and alcohol testing conducted pursuant to this part complies with the procedures set forth in [49 CFR part 40](/cfr/49/part40.md) and any exemptions issued to that employer by the Department of Transportation in accordance with [49 CFR 40.7](/cfr/49/40.7.md).
