# §120.1. Applicability.


This part applies to the following persons:

- (a) All air carriers and operators certificated under [part 119](/cfr/14/part119.md) of this chapter authorized to conduct operations under [part 121](/cfr/14/part121.md) or [part 135](/cfr/14/part135.md) of this chapter, all air traffic control facilities not operated by the FAA or by or under contract to the U.S. military; and all operators as defined in [14 CFR 91.147](/cfr/14/91.147.md).
- (b) All individuals who perform, either directly or by contract, a safety-sensitive function listed in subpart E or subpart F of this part.
- (c) All [part 145](/cfr/14/part145.md) certificate holders located in the territory of the United States who perform safety-sensitive functions and elect to implement a drug and alcohol testing program under this part.
- (d) Beginning December 20, 2027, all [part 145](/cfr/14/part145.md) certificate holders outside the territory of the United States who perform safety-sensitive maintenance functions on [part 121](/cfr/14/part121.md) air carrier aircraft, except that [section 120.5](/cfr/14/120.5.md) and subparts [E](/cfr/14/subpartE.md) and [F](/cfr/14/subpartF.md) of this part do not apply to [part 145](/cfr/14/part145.md) certificate holders outside the territory of the United States who perform safety-sensitive maintenance functions on [part 121](/cfr/14/part121.md) air carrier aircraft that have obtained recognition pursuant to [§ 120.10](/cfr/14/120.10.md).
- (e) **All contractors who elect to implement a drug and alcohol testing program under this part.**
