# §792.41. When does this subpart apply?


This subpart applies if you want to obtain nonpublic records or testimony of an NCUA employee for legal proceedings. It doesn't apply to the release of records under the Freedom of Information Act (FOIA), [5 U.S.C. 552](/usc/5/552.md), or the Privacy Act, [5 U.S.C. 552a](/usc/5/552a.md), or the release of records to federal or state investigatory agencies under [§ 792.32](/cfr/12/792.32.md).
