# §45.12. Capital.


A covered swap entity shall comply with:

- (a) In the case of a covered swap entity that is a national bank or Federal savings association, the minimum capital requirements as generally provided [12 CFR part 3](/cfr/12/part3.md).
- (b) In the case of a covered swap entity that is a Federal branch or agency of a foreign bank, the capital adequacy guidelines applicable as generally provided under [12 CFR 28.14](/cfr/12/28.14.md).
