# §263.55. Board as Presiding Officer.


The Board may, in its discretion, designate itself, one or more of its members, or an authorized officer, to act as presiding officer in a formal hearing. In such a proceeding, the authority of Board or its designee will include all the authority provided to an ALJ under this part. Proposed findings and conclusions, briefs, and other submissions by the parties permitted in [subpart A](/cfr/12/subpartA.md) of this part must be filed with the Secretary for consideration by the Board. Sections [263.38](/cfr/12/263.38.md) and [263.39](/cfr/12/263.39.md) will not apply to proceedings conducted under this section.
