# §263.450. Scope.

- (a) The procedures of this subpart must be followed when a formal investigation is instituted and conducted pursuant to: [section 8(n)](/cfr/12/8.md?p=n) of the FDIA ([12 U.S.C. 1818(n)](/usc/12/1818.md?p=n)); [section 10(c)](/cfr/12/10.md?p=c) of the FDIA ([12 U.S.C. 1820(c)](/usc/12/1820.md?p=c)); [section 7(j)(15)](/cfr/12/7.md?p=j-15) of the FDIA ([12 U.S.C. 1817(j)(15)](/usc/12/1817.md?p=j-15)); section 5(f) of the Bank Holding Company Act ([12 U.S.C. 1844(f)](/usc/12/1844.md?p=f)); sections [10(b)(4)](/cfr/12/10.md?p=b-4) and [10(g)(2)](/cfr/12/10.md?p=g-2) of HOLA (12 U.S.C. [1464(b)(4)](/usc/12/1464.md?p=b-4) and [1467a(g)(2)](/usc/12/1467a.md?p=g-2)); or [section 162](/cfr/12/162.md) of the Dodd-Frank Act ([12 U.S.C. 5362](/usc/12/5362.md)).
- (b) Nothing in this subpart prohibits the Board from conducting informal investigations or obtaining information by any means other than a subpoena issued pursuant to this subpart.
- (c) This subpart does not apply to adjudicatory proceedings as to which hearings are required by statute, the rules for which are contained in [part 262](/cfr/12/part262.md) of this chapter and [subpart A](/cfr/12/subpartA.md) of this part.
