# §1263.8. Subject to inspection and regulation requirement.


An applicant shall be deemed to be subject to inspection and regulation, as required by section 4(a)(1)(B) of the Bank Act ([12 U.S.C. 1424 (a)(1)(B)](/usc/12/1424.md?p=a-1-B)) and [§ 1263.6(a)(2)](/cfr/12/1263.6.md?p=a-2) if, in the case of an insured depository institution or insurance company applicant, it is subject to inspection and regulation by its appropriate regulator. A CDFI applicant that is certified by the CDFI Fund is not subject to this requirement.
