# §1209.4. Scope and authority.


The rules of practice and procedure set forth in [Subpart C](/cfr/12/subpartC.md) (Rules of Practice and Procedure) of this part shall be applicable to any hearing on the record conducted by FHFA in accordance with [sections 1371 through 1379D](/cfr/12/1371..1379D.md) of the Safety and Soundness Act ([12 U.S.C. 4631 through 4641](/usc/12/4631..4641.md)), as follows:

- (a) Cease-and-desist proceedings under sections [1371](/cfr/12/1371.md) and [1373](/cfr/12/1373.md) of the Safety and Soundness Act, (12 U.S.C. [4631](/usc/12/4631.md), [4633](/usc/12/4633.md));
- (b) Civil money penalty assessment proceedings under sections [1373](/cfr/12/1373.md) and [1376](/cfr/12/1376.md) of the Safety and Soundness Act, (12 U.S.C. [4633](/usc/12/4633.md), [4636](/usc/12/4636.md)); and
- (c) Removal and prohibition proceedings under sections [1373](/cfr/12/1373.md) and [1377](/cfr/12/1377.md) of the Safety and Soundness Act, (12 U.S.C. [4633](/usc/12/4633.md), [4636a](/usc/12/4636a.md)), except removal proceedings under [section 1377(h)](/cfr/12/1377.md?p=h) of the Safety and Soundness Act, ([12 U.S.C. 4636a(h)](/usc/12/4636a.md?p=h)).
