# §9008.5. Adjustment of entitlement.

- (a) The entitlements established by [11 CFR 9008.4](/cfr/11/9008.4.md) shall be adjusted on the basis of the Consumer Price Index pursuant to the provisions of [52 U.S.C. 30116(c)](/usc/52/30116.md?p=c).
- (b) The entitlements established by [11 CFR 9008.4](/cfr/11/9008.4.md) shall be adjusted so as not to exceed the difference between the expenditure limitations of [11 CFR 9008.8(a)](/cfr/11/9008.8.md?p=a) and the amount of private contributions received under [11 CFR 9008.6(a)](/cfr/11/9008.6.md?p=a) by the national committee of a political party. Except as provided in [11 CFR 9008.12(b)(7)](/cfr/11/9008.12.md?p=b-7), in calculating these adjustments, amounts expended by Government agencies and municipal corporations in accordance with [11 CFR 9008.53](/cfr/11/9008.53.md); in-kind donations by businesses to the national committee or convention committee in accordance with [11 CFR 9008.9](/cfr/11/9008.9.md); expenditures by host committees in accordance with [11 CFR 9008.52](/cfr/11/9008.52.md); expenditures to participate in or attend the convention under [11 CFR 9008.8(b)(2)](/cfr/11/9008.8.md?p=b-2); and legal and accounting services rendered in accordance with [11 CFR 9008.8(b)(4)](/cfr/11/9008.8.md?p=b-4) will not be considered private contributions or expenditures counting against the limitation.
