# §612.6. Petition to the Department's Office of Hearings and Appeals.


In order to exhaust its administrative remedies, an owner/operator who is aggrieved by the Secretary's decision to affirm, withdraw, or modify the notice of recapture as provided in [§ 612.5(c)](/cfr/10/612.5.md?p=c) may file a petition with the Department's Office of Hearings and Appeals in accordance with [10 CFR 1003.11](/cfr/10/1003.11.md) not later than thirty days after notification of the Department's decision.
