# §451.1. Purpose and scope.

- (a) The provisions of this part cover the policies and procedures applicable to the determinations by the Department of Energy (DOE) to make incentive payments, under the authority of [42 U.S.C. 13317](/usc/42/13317.md), for electric energy generated and sold by a qualified renewable energy facility owned by a State or political subdivision thereof; a not-for-profit electric cooperative; a public utility described in section 115 of the Internal Revenue Code of 1986; an Indian tribal government or subdivision thereof; or a Native corporation.
- (b) Determinations to make incentive payments under this part are not subject to the provisions of [10 CFR part 600](/cfr/10/part600.md) and such payments shall not be construed to be financial assistance.
