# §34.123. Criminal penalties.

- (a) Section 223 of the Atomic Energy Act of 1952, as amended, provides for criminal sanctions for willful violation of, attempted violation of, or conspiracy to violate, any regulation issued under one or more of §§ [161b](/cfr/10/161b.md), [161i](/cfr/10/161i.md), or [161o](/cfr/10/161o.md) of the Act. For purposes of [Section 223](/cfr/10/223.md), all the regulations in [10 CFR part 34](/cfr/10/part34.md) are issued under one or more of §§ [161b](/cfr/10/161b.md), [161i](/cfr/10/161i.md), or [161o](/cfr/10/161o.md), except for the sections listed in [paragraph (b)](#b) of this section.
- (b) The regulations in [10 CFR part 34](/cfr/10/part34.md) that are not issued under sections [161b](/cfr/10/161b.md), [161i](/cfr/10/161i.md), or [161o](/cfr/10/161o.md) for the purposes of [Section 223](/cfr/10/223.md) are as follows: §§ [34.1](/cfr/10/34.1.md), [34.3](/cfr/10/34.3.md), [34.5](/cfr/10/34.5.md), [34.8](/cfr/10/34.8.md), [34.11](/cfr/10/34.11.md), [34.13](/cfr/10/34.13.md), [34.111](/cfr/10/34.111.md), [34.121](/cfr/10/34.121.md), 34.123.
